الكِتَابُ الرَّابع: الهبات واللقطة

3122 - (خ) عَنْ أَبِي هُرَيْرَةَ رضي الله عنه، عَنِ النَّبِيِّ صلّى الله عليه وسلّم قَالَ: (لَوْ دعِيتُ إِلَى ذِرَاعٍ، أَوْ كُرَاعٍ [1] ، لأَجَبْتُ، وَلَوْ أُهْدِيَ إِلَيَّ ذِرَاعٌ أَوْ كُرَاعٌ لَقَبِلْتُ) .

Abu Hurayrah (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "If I am invited to a meal of a sheep's trotter or arm, I would accept the invitation, and if an arm or trotter were gifted to me, I would accept the gift."

3126 - (ق) عَنِ النُّعْمَانِ بْنِ بَشِيرٍ: أَنَّ أَبَاهُ أَتَى بِهِ إِلَى رَسُولِ اللهِ صلّى الله عليه وسلّم فَقَالَ: إِنِّي نَحَلْتُ [1] ابْنِي هَذَا غُلاَماً، فَقَالَ: (أَكُلَّ وَلَدِكَ نَحَلْتَ مِثْلَهُ) ؟ قَالَ: لاَ، قَالَ: (فَارْجِعْهُ) .

An-Nu‘mān ibn Bashīr (may Allah be pleased with him) reported: My father gave me some of his property as a gift. My mother ‘Amrah bint Rawāha said: I shall not be satisfied until you make the Messenger of Allah (may Allah's peace and blessings be upon him) a witness to it. My father went to the Messenger of Allah (may Allah's peace and blessings be upon him) in order to make him witness to the gift he has given me. The Messenger of Allah (may Allah's peace and blessings be upon him) asked him: "Have you done the same with all your children?" He said: 'No.' Thereupon, he said: "Fear Allah, and be just regarding your children." So my father returned and took back the gift. According to another wording, the Prophet (may Allah's peace and blessings be upon him) said: "Then do not make me a witness to this, for, indeed, I do not bear witness to injustice." According to a third wording, he said: "Then let someone other than me be a witness to this."

3131 - (ق) عَنِ ابْنِ عَبَّاسٍ رضي الله عنهما قَالَ: قَالَ النَّبِيُّ صلّى الله عليه وسلّم: (العَائِدُ فِي هِبَتِهِ، كالْكَلْبِ يَقِيءُ، ثُمَّ يَعُودُ في قَيْئِهِ) .

‘Abdullāh ibn ‘Abbās (may Allah be pleased with him) reported that the Prophet (may Allah's peace and blessings be upon him) said: "The one who takes back the gift he has given to someone is like one who eats his vomit." In another wording: "The one who takes back the charity that he gave is like a dog that vomits then eats its vomit."

3133 - (ق) عَنْ عَبْدِ اللهِ بْنِ عُمَرَ رضي الله عنهما: أَنَّ عُمَرَ بْنَ الخَطَّابِ حَمَلَ عَلَى فَرَسٍ في سَبِيلِ اللهِ، فَوَجَدَهُ يُبَاعُ، فَأَرَادَ أَنْ يَبْتَاعَهُ، فَسأَلَ رَسُولَ اللهِ صلّى الله عليه وسلّم فَقَالَ: (لاَ تَبْتَعْهُ، وَلاَ تَعُدْ في صَدَقَتِكَ) .

‘Umar ibn al-Khattāb (may Allah be pleased with him) reported: 'I donated a horse for Jihad. The man who had the horse neglected it, so I wanted to buy it back, thinking that he would sell it for a cheap price. I asked the Prophet about this, and he said: "Do not buy it back and do not take back your charity, even if he gives it to you for one dirham, for the one who takes back his gift is like the one who takes back his vomit."
